June 2009 Test case hearing in House of Lords The latest stage in the long-running saga of the so-called test case started in the House of Lords on 23 June. This is as a result of the banks appealing against the earlier Court of Appeal ruling that confirmed that unauthorised overdraft fees and other such charges are subject to the test of fairness. The case lasted a few days and then the Lords retired to consider their decision. It is thought that they will announce their decision some time in the autumn, but no date has been given.
