Peter vs. MBNA

Peter had been charged on his MBNA credit card £25 per month late payment fee and £25 per month over limit fee for a few years. He requested copy statements from MBNA but they failed to produce them. Peter issued a claim on the basis of statements that he did have plus estimates for other periods. He claimed for £1325 in charges, plus interest of £409, plus court fee, plus he claimed £500 for mental distress.

MBNA agreed to pay back the charges and they admitted that the charges were more than what Peter had claimed for(!), plus interest and court costs, but not for the mental distress. Their total offer was for £2075 versus the total claimed of £2354. Peter accepted this offer.
